MultiWander fulfills orders according to the following General Terms and Conditions (GTC). Client conditions that conflict with or differ from those established below are not recognized unless MultiWander explicitly agrees to their applicability in writing.
1. Subject of the Agreement
MultiWander offers its clients tour packages, flights, hotel reservations, car rentals, etc. (hereinafter referred to as “Travel Services”) from various tour operators, airlines, travel agencies, etc. (hereinafter referred to as “Providers”) as an intermediary and facilitates the conclusion of agreements on behalf of and for these Providers. MultiWander intermediates the travel agreement solely between the client and the respective Provider. Payments are made directly to the Providers only.
1.1. Definitions
Provider: The entity organizing the travel service, directly responsible for fulfilling the agreement with the client and delivering all services.
MultiWander: The entity acting under an agency agreement, mediating the sale of travel services organized by the Provider. MultiWander is not responsible for the execution of the service.
Client: An individual or legal entity who has entered into an agreement with the Provider through MultiWander for participation in a travel service.
2. Conclusion of the Mediation Agreement
2.1 All offers from MultiWander are non-binding and free of obligation.
2.2 Package Tours and Last-Minute Travel
When a client enters their details into the online booking form and clicks the “confirm booking” button, they commission MultiWander to mediate the booking for the requested travel service (hereinafter referred to as: booking request) with the Provider. MultiWander then sends the client an email summarizing the booking request, including details about the travel service Provider, the price of the travel service, who and in what form will receive the booking documents, who is authorized to receive payments, and the airline carrier, if already determined. Along with the booking confirmation email, the mediation agreement for the travel service between the client and MultiWander is concluded. Due to availability and technical live system checks, the price is dynamic and will only be blocked at the moment of clicking “Book Now”.
2.3 Combined Travel
The client sends a booking request to MultiWander, to which MultiWander replies with a non-binding written offer for the travel service. Upon confirmation of this non-binding offer by the client, they receive a travel application from MultiWander, including the Provider’s GTC. The mediation contract is concluded by the signature of the client, the return of the travel request and the confirmation of the availability at the dynamic price.
2.4 The client does not have the right to withdraw from the mediation agreement with MultiWander.
3. Conclusion of the Travel Service Agreement with the Provider
MultiWander promptly forwards the booking request to the Provider, who then checks the availability of the booking request. If the requested travel service is available, the Provider sends the client confirmation of the travel service, including an invoice and a travel security certificate. In order to receive the Travel Security Certificate, the customer must book a minimum of two travel services in one booking. If the travel service is not available, the client will be informed as soon as possible.
4. General Terms and Conditions of Providers (GTC)
The mediation agreement concerning the travel service is based on the terms and conditions set by the respective Provider. These conditions regulate, among other things, payments, cancellations, changes to bookings, and liability, and are provided to the client during the booking process before the booking request is sent if available. The client confirms and accepts these conditions by sending the booking request.
5. Client Obligations
5.1 Minors under 18 years of age are not permitted to make bookings.
5.2 Information provided by clients regarding registrations, bookings, their execution, and payments must be complete and accurate.
5.3 The client is obliged to promptly check the mediation confirmation, booking confirmation, or other received travel documents by email or mail for accuracy. Any discrepancies must be reported immediately to MultiWander via email at info@multiwander.com. Any discrepancies may result in additional charges, which may have to be paid directly to the provider. Discrepancies or deviations reported too late from receipt of mediation confirmation, booking confirmation, or other travel documents will not be considered as a free service.
5.4 MultiWander is not authorized to accept client complaints regarding the travel service; these should be addressed directly to the Provider.
5.5 If the client does not receive documents (travel documents, tickets, etc.) within 7 working days of the final payment, they are required to promptly contact MultiWander.
6. Termination of the Mediation Agreement and Changes or Cancellation of the Travel Service Agreement
6.1 Termination of the Mediation Agreement is only possible if MultiWander has been given a reasonable period to fulfill the agreement before its termination, which must be at least 48 hours on working days from Monday to Friday. Periods falling on weekends and public holidays are not included. The right to extraordinary termination of the agreement remains unaffected.
6.2 Changes or Cancellation of the Travel Service Agreement
The termination or cancellation of the travel service by the Provider is subject to the Provider’s conditions and may also be reported by the client to MultiWander in writing (e.g. email). MultiWander does not charge its own fees or handling fees for this. However, the possibility of changing or canceling a reservation is based solely on the relevant agreement with the Provider, including its related conditions and terms. This also applies to any costs incurred by the Provider in this context, such as cancellation fees.
7. Liability
7.1 MultiWander’s liability is governed by the law, unless limitations are specified in the following provisions.
7.2 MultiWander is not responsible for the success of the mediation nor for the flawless execution of the travel service itself, but only for ensuring that the mediation is conducted with professional care.
7.3 MultiWander strives to provide accurate information on its online travel portal. MultiWander receives detailed information about travel services from relevant providers. MultiWander cannot verify the accuracy and currentness of this information. Therefore, MultiWander does not make any warranties or representations regarding the accuracy and currentness of this information. This also applies to information provided by third parties on the online travel portal. MultiWander is not liable for the availability of travel services at the time of booking or for the provision of the booked travel service.
7.4 However, MultiWander’s liability is not excluded if MultiWander breaches its own obligations arising from the mediation agreement. MultiWander is fully liable if the cause of the damage results from intentional or gross negligence or breach of duties by MultiWander, its legal representatives, or agents.
7.5 MultiWander is also liable for negligent breaches of essential contractual obligations. Essential contractual obligations are those necessary to achieve the purpose of the contract. MultiWander’s liability for property damage is limited to foreseeable, direct damages that typically arise and to the maximum amount of the booked travel service that forms the basis of the client’s claim in each individual case.
7.6 MultiWander’s liability is not extended further.
8. Limitation of Liability
8.1 Any claims for damages shall be time-barred after one year from their occurrence.
8.2 The limitation period mentioned in section 8.1 above does not apply to claims related to personal injury or loss of life. It also does not apply to claims for damages resulting from intentional or gross negligence and breach of duties by the travel agent, its representatives, or agents. These claims are governed by statutory regulations.
9. Travel Insurance
MultiWander strongly recommends that clients purchase travel insurance, particularly trip cancellation insurance.
10. Passport, Visa, and Health Regulations
10.1 MultiWander provides information on its website for clients who are European Union citizens about passport, visa, and health regulations. However, it is the client’s responsibility to check the current information regarding travel requirements on the relevant sources (e.g. Ministry of Foreign Affairs) before concluding the agreement and before starting the trip. Information for citizens of other countries is provided by the relevant consulate.
10.2 MultiWander does not mediate or bear responsibility for the timely issuance and receipt of necessary visas by the relevant diplomatic mission.
10.3 The client is responsible for obtaining and possessing the necessary travel documents, any required vaccinations, and complying with customs and currency regulations. Any consequences arising from non-compliance with these regulations, including cancellation costs, are borne by the client.
10.4 The client should also obtain information in a timely manner about necessary preventive measures, including vaccinations and protection against infections, and seek medical advice on health risks if necessary. References should be made to general information, especially from health authorities, travel medicine specialists, tropical medicine specialists, and travel medicine information services.
11. Data Protection Policy
MultiWander makes every effort to protect the privacy and personal data of its clients. Data provided during booking and use of our services is processed in accordance with applicable legal provisions, particularly GDPR. Personal data is used solely for the purpose of contract fulfillment and customer service. We do not share data with third parties without explicit client consent, except where necessary for service execution. Clients have the right to access, correct, and request the deletion of their data.
MultiWander may communicate with clients electronically or by other available means to fulfill the contract. A copy of the contract text containing order details is stored by MultiWander. In case of suspected criminal activity, MultiWander reserves the right to disclose collected information to contract partners, third parties, or law enforcement agencies.
12. General Provisions
12.1 MultiWander is a travel agency operating exclusively online. MultiWander offer their service for genuine customers only.
12.2 MultiWander is obliged to adhere to all terms of the agency agreement with the Supplier and must not act in a way that infringes upon the interests of the Supplier or the Client.
12.3 Any disputes arising from the execution of travel service agreements are resolved based on the terms specified by the Supplier. MultiWander is not a party to these disputes but is required to cooperate in their resolution. Any legal disputes arising from or related to the contract will be resolved in accordance with Polish law, excluding legal provisions referring to other legal systems. The UN Convention on Contracts for the International Sale of Goods does not apply.
12.4 If the client is a business, a legal entity under public law, a special fund under public law, or if the client does not have a permanent residence in Poland, the jurisdiction for legal disputes arising from or related to the contract will be the location of MultiWander’s operations, i.e., Poland.
12.5 Any additional agreements, amendments, or supplements must be made in writing to be valid, including resolutions regarding the waiver of the written form requirement. 12.6 If any provisions are or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be deemed to be replaced by a provision that comes as close as possible to the meaning and purpose of the invalid provision in a legally effective manner. The same applies to any loopholes.
